Terms and conditions for Avinor's Wireless LAN.

You are using the Avinor Wireless LAN at your own risk. Avinor bears no responsibility whatsoever for external parties or individuals intruding your computer ("hacking") or eavesdropping into your exchange of information while you are connected to the Avinor's Wireless LAN.

1. General

These terms and conditions apply to use of services in connection with Avinor’s Wireless Local Area Network (Avinor WLAN).

Definitions

Avinor WLAN (Wireless Local Area Network):
     - Wireless Network at Avinor airports owned and operated by Avinor AS.

Free Service:
     - Access to Avinor WLAN that gives the User free access to defined services in connection with Avinor’s WLAN portal.

Internet Service:
     - Internet access via Avinor's WLAN.

The User:
     - Person that uses the Services.

ISP - Internet Service Provider:
     - The ISP with whom the User has a WLAN subscription and that authenticates the User in connection with Internet access (the Internet Service).

2. The object

Avinor WLAN gives Users access to the following services: The Free Service The Internet Service The Free Service allows the User free access to the Avinor WLAN portal and appurtenant set of WEB pages. Avinor reserves the right to change these WEB pages without prior notice. The Internet Service allows the User access to the worldwide web (the Internet). Access requires that the User has a valid Internet subscription with an ISP or has bought a temporary short-term subscription for access to the Internet at Oslo Airport (or one of Avinor's dealers in connection with this Service)

3. Conditions

Use of the Services is at the User’s risk and responsibility. This presupposes that the User him/herself implements the necessary security precautions to protect his/her computer equipment and peripheral equipment and the information that the User wishes to exchange via Avinor WLAN.

4. Treatment of information

Specific particulars pertaining to the User’s use of the Internet Service will be recorded and stored for up to six months for the purpose of documentation and issuing invoices. No other information about the User’s use of the Services will be recorded.

5. Prices and invoicing

The User will be invoiced for his/her use of the Internet Service by the ISP that authenticates the User. The User should contact his/her ISP for a price list for use of the Internet Service. For the purpose of invoicing, the ISP will receive from Avinor the User’s Login ID, the time, duration and number of bytes sent and received.

6. Avinor’s duties

6.1 Access, operation, etc.

Avinor is obligated to ensure that the User has access to the Services as described in these Terms and Conditions.

6.2 Duty of Confidentiality

Pursuant to Section 9-3 of the Norwegian Telecommunications Act, Avinor is obligated to treat as confidential details regarding the User’s use of the Services and the content of the Customer’s telecommunications. Nevertheless, these kinds of details may be disclosed with the User’s consent or to the public authorities, courts and prosecuting authority if Avinor is legally obligated to disclose this information.

6.3 Customer Service

In the event of the need for user support or if an error situation arises, the User shall contact his/her ISP’s customer service facilities. Opening hours, telephone numbers and e-mail addresses of customer service facilities are available on the WLAN-portal. (Click on Service Providers in the top menu)

6.4 Logging

Avinor WLAN logs activity on the network. This practice is in accordance with the Regulations pertaining to Section 2-20 of the Norwegian Act relating to Personal Data Filing Systems, etc. and this information is only used for purposes permitted by these provisions or by other statutory or regulatory provisions. Avinor does not store any subscription information about the User in its systems.

7. The User’s duties

7.1 Installation etc.

The User is responsible for the installation, connection and configuration of his/her own equipment that are necessary to use the Service.

7.2 Security

Avinor WLAN is an open wireless network with limited security functions. In connection with logging on and authentication, the User’s log-in ID and password that are used for access to the Internet Service are protected (encrypted) using HTTP/SSL. All other communication is transferred unencrypted. We would therefore recommend Users who wish to protect their communication to use the necessary encryption software (VPN solutions). All traffic via a wireless network can easily be monitored. We would also strongly recommend that Users protect their PCs against illegal entry by other Users of the Avinor WLAN by means of a personal firewall. The User should contact his/her ISP for more information about this kind of software. If a personal firewall is not being used, the file-sharing function should be disabled while using the wireless network. File sharing allows third parties access (read/write access) to file directories in the User’s equipment. If the User suspects that he/she has been subject to attempted "hacking" or "cracking" while using the Services, he/she should contact his/her ISP immediately. Users that are unsure as to whether they have adequate security systems on their equipment are recommended to disable the radio card or shut down their equipment.

7.3 Hacking

The User is obligated not to attempt to gain illegal access to or undertake other activities aimed at: other Users of Avinor WLAN that he/she discovers on Avinor WLAN, the systems that provide access to the Service, systems and/or networks connected to Avinor WLAN. This also applies to other attempts at breaching security, or preventing other Users from gaining access to the Services or unnecessarily disrupting the network traffic in the Avinor WLAN. The User does not have access to the Network Management system of the Service or other networks connected to the Network Management System.

7.4 Netiquette

The User is obligated to acquaint him/herself with the content of and observe the rules and customs of etiquette that apply on the Internet. Users are not permitted to spread computer viruses or other harmful programs or to use the Service for e-mail bombing, sending out advertising e-mails or other forms of e-mail sent to several users they do not know, etc. Nor are Users permitted to use a false name and/or address. The User is also obligated to demonstrate common sense and general good manners when using the Service. The User is further obligated not to display openly to other people at the airport the contents of communications that may be offensive or in violation of Norwegian legislation.

7.5 Applicable legislation

The User is obligated to use the Service in accordance with the currently applicable legislation in Norway.

7.6 Resale and extended use

The Services may only be used by the User personally and may not be sold, leased out or in any other way made available to a third party, for payment or for free.

8. Faults and deficiencies in the Services

8.1 Reporting faults and deficiencies

All faults and deficiencies in the Avinor WLAN shall be reported to the User’s ISP. When reporting faults, the User must state the time, place (i.e. where in the airport) and give a description of the fault or deficiency.

8.2 Compensation

8.2.1 Direct losses

Avinor is not liable to the User for direct losses caused by deficiencies in the Service. Direct losses are defined as necessary and documented extra expenses that the Customer incurred as a result of the fault.

8.2.2 Indirect losses

Avinor is not liable to the User for indirect losses caused by deficiencies. Indirect losses are defined as: Losses as a result of decreased or ceased production or sale (interruption). Losses as a result of the fact that the service cannot be used as predicted (deprivation). Lost profits as a result of a contract with a third party being dropped or not being fulfilled.

9. The User’s breach of contract

9.1 Closure in the event of breach of contract

Avinor is entitled to deny the User access to Avinor WLAN (for an unlimited period of time) if the Customer uses the Services in violation of articles 3 and/or 7.3 to 7.6. The User is not entitled to be informed of the reason for denied access.

10. Limitation of liability

The Service is based on the Users themselves providing protection for their confidential data against access by unauthorised persons. Avinor does not exercise any monitoring of the data that are sent and received via the Services and cannot be held liable for this. Avinor cannot be held liable for losses, damage or other inconveniences in connection with destruction of the User’s data, interruption, undelivered data, data delivered to the wrong recipient, etc. Nor can Avinor be held liable if other Users of the Service, intentionally or unintentionally, gain access to the User’s computer resources and disrupt or render difficult the flow of information.

11. Indemnity

The User is obligated to hold Avinor harmless and indemnified against any claims that third parties might bring against Avinor as a result of the User’s use of the Services. In these kinds of cases, the User has the right to accede to the claim or, in collaboration with Avinor, will be given the opportunity to protect his/her interests in the same way as if the claim was against the User him/herself. If a claim of this nature is brought against Avinor, the User shall also cover, in addition to the direct financial loss, any expenses connected to assistance in dealing with the claim properly and other expenses that are clearly related to the third party’s claim.

12. Maintenance

Avinor has the right to implement measures that may entail a break, disturbances or changes in the Service that are regarded as necessary
